Todd brings a wealth of experience in medical malpractice, general liability, municipal liability, appellate practice and personal injury. He is active in the community and admitted to practice law in New York and Connecticut.
On March 23, 2015, John Barker successfully conducted an intra-trial Frye Hearing that led to the striking of plaintiff’s expert’s testimony in a medical malpractice action. Mr. Barker argued that there was no support in the medical literature for the causation theory espoused by plaintiff’s expert urologist. After determining the Frye issue, the trial court granted Mr. Barker’s motion for a dismissal based upon plaintiff’s inability to establish a prima facie case.

Kiki has dedicated her practice to representing health care providers in medical malpractice actions in the New York metropolitan area. VBPMP welcomes Frederick W. Vasselman to the firm as Of Counsel. Mr. Vasselman is a general practice attorney specializing in Real Estate, Civil Litigation and Family/Matrimonial Law. He is a retired New York City Police Officer, who interned for the Honorable Peter O’Donohue of the Queens County Supreme Court. Frederick specializes in Real Estate, Civil and Criminal Litigation, and Small Business Administration.

The firm is pleased to announce that Alexander M. Fear has joined the firm as Of Counsel. Mr. Fear represents physicians and administrators at medical centers and private practices around the metro area. Acting as General Counsel and Chief Compliance Officer for many of his clients, Mr. Fear works with them as they navigate the maze of healthcare regulations including HIPAA and HITECH, Stark and the Anti-kickback regulations. As General Counsel, Mr. Fear assists his clients in all aspects of their practices, including corporate formation, drafting governance, compliance and various other operational documents. He is a welcome addition to our Healthcare Law team led by Kevin D. Porter. Mr. Fear also has extensive experience in real estate law, having served as General Counsel for a real estate corporation engaged in the acquisition, ownership and management of more than 150 commercial and residential buildings in and around New York City.

A week after opening, the firm’s senior most trial attorney, Alfred P. Vigorito, gave a power point presentation on Grand Rounds at an area hospital before approximately 100 physicians. Mr. Vigorito presented a case study of an action he had successfully handled in the past. The discussion was very well received by those in attendance.
