Gary W. Patterson, Jr. Obtains Defense Verdict

On October 5, 2018, Gary W. Patterson, Jr. obtained a defense verdict on behalf of his client, a surgeon, at the Supreme Court, Westchester County.  The case concerned claims of a failure to properly perform a hernia repair, together with claims of negligent wound care post-operatively.  The plaintiff, a 46 year old woman, underwent a ventral hernia repair with mesh in April of 2014.  It was alleged that the defendant physician removed excessive tissue during the surgery, leading to inordinate tension on the wound, compromising healing.  Plaintiff went on to develop an infection and wound dehiscence.  Plaintiff’s counsel sought an award of $1.1 million, arguing that his client was left with horrific scarring and a lost umbilicus, despite multiple surgeries to improve her cosmetic appearance.  The jury deliberated over night and returned a defense verdict in favor of Mr. Patterson’s client.
