Alfred P. Vigorito Secures Unanimous Defense Verdict

We are pleased to announce that our Partner, Alfred P. Vigorito, obtained a unanimous defense verdict in the case of Dinardo v Mitarotonda on Sept. 7th before Judge Charles Wood and a Jury in Westchester Supreme Court. This matter sounding in the common law theory of Constructive Trust alleged that our client had created a real estate trust valued at $500,000 in favor of his in-laws. Our client contended that he purchased the single family home as an investment and rented it to his in-laws. After a bitter divorce from his wife, our client sought to evict his in-laws who then commenced this action which had been pending for nearly three years and had survived a motion for summary judgment. At trial, Mr. Vigorito’s mastery of cross examination demonstrated the inconsistencies in plaintiff’s proof leading to a verdict within 20 minutes of deliberations. This was Mr. Vigorito’s 4th straight defense verdict representing Mr. Mitarotonda and/or his corporation Chief Fire Prevention & Mechanical Inc., New York’s largest supplier of restaurant exhaust systems.
